A Brief Analysis of the Principle of Good Faith in Patent Application
[Purposes]Based on the newly promulgated implementation rules of the Patent Law of China,this paper discusses the principle of good faith in patent application,and provides reference for examin-ers on how to conduct substantive examination of patents based on the principle of good faith.[Methods]By sorting out the origin of the principle of good faith in Chinese patent application,so as to assist exam-iners in understanding and implementing related work.[Findings]The continuous improvement of the principle of good faith in China 's patent law system reflects the determination of the Chinese govern-ment to crack down on dishonest behavior in patent application.It is necessary to apply the principle of good faith in the substantive examination of patents to help the high-quality development of patents.[Conclusions]The target of the current combat is mainly for abnormal application;examiners should comprehensively study and master the relevant provisions of the new patent laws and regulations,en-hance the ability to investigate abnormal applications,and reasonably and effectively use the principle of good faith in the practice of patent substantive examination,in order to comprehensively improve the quality of patents as the backbone force.
