[目的]分析郑州市知识产权司法保护现状,探寻其未来发展方向.[方法]运用统计调查法和典型调查法,通过对相关文献、文件、判例的汇总整理与分析,总结郑州市知识产权司法保护情况,并参考同时期国内其他城市的经验.[结果]郑州市知识产权司法保护问题主要分为民事诉讼程序及审判团队专业素养两个方面.[结论]未来可通过完善诉讼程序、转移败诉风险、发展技术调查官制度等方面进一步加大知识产权司法保护力度.
Abstract
[Purposes]This paper aims to summarize the current situation of judicial protection of intellec-tual property in Zhengzhou and explore the future development direction.[Methods]By the statistical survey method and the typical survey method and through the summary as well as analysis of relevant lit-erature,documents and precedents,this paper summarizes the judicial protection of intellectual property rights in Zhengzhou,and refers to the experience of other cities in the same period.[Findings]Prominent problems were found mainly in two aspects:civil procedure and professional quality of trial team.[Con-clusions]In the future,the judicial protection of intellectual property rights can be further strengthened by improving the litigation procedure,transferring the risk of losing the lawsuit,and developing the sys-tem of technical investigators.
