Reconstruction of Copyright Duty of Care of Network Service Provider under Algorithm Technology
[Purposes]The duty of care of network service providers under the existing"safe harbor"rules should be adjusted to adapt to the development of algorithmic technologies and balance the interests of all parties.[Methods]The existing duty of care is analyzed through comparative studies,jurisprudence-economics studies and other methods.[Findings]Algorithm technology has affected the three elements of duty of care,and the existing duty of care rules are already difficult to meet the principle of balance of in-terest.[Conclusions]The introduction of limited ex ante filtering obligations changes the passive liability mode,which can effectively resolve the problems of internet copyright infringement and balance the in-terests of the copyright owners and the network service providers.In terms of specific settings,the scope of liability subjects may be strictly limited according to the comprehensive indicators.Assessment criteria can be made up of turnover,registered users,access to data,level of control,etc.A hierarchical filtering method is established,and two filtering behaviors,complete filtering and flow restriction,are adopted.
