摘要
[目的]进一步完善我国地理标志保护制度体系,充分发挥地理标志促进特色经济发展、助力乡村振兴的关键作用.[方法]本文就地理标志保护制度在申请主体、受理渠道、审查标准、监管保护、侵权救济机制等方面存在问题进行分析,针对性提出改进建议.[结果]我国地理标志保护制度在商标保护与专门保护并行模式下,存在重叠保护多头管理、评审指标设置不合理、监管惩戒机制不完善、"特定地名"的合理使用范围不清晰等问题,应从立法层面予以完善.[结论]建议从研究制定地理标志保护专门法、构建全国统一的地理标志认证体系等方面对地理标志保护体系予以改进完善,同时注重强化与现行法律制度衔接、科学设置评审指标体系、统筹共促区域公用品牌和地理标志发展.
Abstract
[Purposes]This paper aims to further improve China's geographical indication protection sys-tem,give full play to the key role of geographical indications in promoting the development of characteris-tic economy and helping rural revitalization.[Methods]By analyzing of the application subject,accep-tance channels,review standards,regulatory protection,infringement relief mechanism and other aspects of the system of geographical indications,this paper puts forward targeted suggestions for improvement.[Findings]Under the parallel mode of trademark protection and special protection,there exists problems in China's geographical indication protection system,such as overlapping protection management,unrea-sonable evaluation index setting,imperfect supervision and punishment mechanism,and unclear scope of reasonable use of"specific geographical names",which should be improved by legislation.[Conclu-sions]It is suggested to formulate a special law on the protection of geographical indications and estab-lish a unified national geographical indication certification system to improve the protection system for geographical indications.At the same time,we should pay attention to strengthen the connection with the current legal system,set up a scientific evaluation index system,and promote the development of re-gional public brands and geographical indications
