The Manifestation and Solution of Conflicts Between Geographical Indications and Geographical Name Trademarks
s:[Purposes]This paper analyzes the manifestation and reasons of the conflict between geo-graphical indications and geographical name trademarks in China to put forward the solution to the prob-lem of conflicts between geographical indications and geographical name trademarks.[Methods]This pa-per mainly adopts the literature research method and comparative research method,analyzing the current situation of the conflict and foreign countermeasures to solve the conflict,and proposing suitable counter-measures to solve the conflict in China.[Findings]The main reasons for the conflict between geographi-cal indications and geographical name trademarks in China are the historical legacy of the law,the weak protection of geographical indications and the defects of the current protection mode.[Conclusions]It is recommended to refer to France to establish the protection mode of geographical indications which is mainly based on the protection of special law,and make corresponding refinement to the legal norms for resolving the conflict from the perspectives of"time first,right first",infringement determination,and limited coexistence.
