Protection of Public Interests in the Copyrighting of Traditional Cultural Resources
Copyrightization is a way to creatively transform and innovatively develop traditional cultural resources. In this process, conflicts and disconnections arise between the proprietary copyright rights and the public interest of cultural re-sources,as well as between intangible resources and the need for tangible protection, and between theories of public interest and operational regulations. The intellectual property system, which has attributes of"public policy",should be designed in conjunction with other relevant policies for cultural inheritance and security.Firstly,it is important to clarify that the subject of public responsibility acts as an agent for"everyone".Secondly, through digitization and dataization, cultural resources can be made"visible"and their use can be managed in an"orderly"manner.Thirdly,by utilizing existing geographical indication systems,a concrete institutional preparation can be made on the operational path of cultural resource data to determine own-ership and benefits in future copyright transactions involving cultural resources.
