Research on Expected Property Interests in Criminal Law
To optimize the business environment and promote the development and growth of the private economy,it is urgent to strengthen the protection of the expected interests of private enterprises at the level of legal order.In the context of the comprehensive protection of property interests by criminal law,whether expected interests deserve criminal law protec-tion depends on the definition of the scope of property interests within criminal law—specifically,whether expected interests are considered property interests.Arguments that deny expected interests as property interests based on criteria such as cer-tainty,physical manageability,and rights confirmability have several shortcomings.Conversely,affirming that expected in-terests are property interests has ample legal,theoretical,and practical justifications.As property interests,expected inter-ests should possess characteristics such as foreseeability,stability,economic value,and limited scope,excluding abnormal,random,emotional,opportunistic,and expanded expected interests.
