Comparative Law and Regional and National Studies:Three Theoretical Traps
While regional and national studies can bring new opportunities for comparative law,the theoreti-cal flaws concealed in comparative law are easily magnified in regional and national studies and even have negative impacts on the development of the two and the practice of extraterritorial rule of law,as is manifested in three traps:dogmatism,postcolonialism,and relativism.Comparative law should,based on retrospection and prevention of these three theoretical traps,seek new theories for its good integration with regional and national studies,and form a method that combines functional and meaningful comparisons,as well as a pluralistic legal view oriented to-wards modernization of the rule of law.
