Research on the Rules of Withdrawal Compensation for Members of Rural Collective Economic Organizations
Members of rural collective economic organizations who withdraw from rural collective economic organizations and lose their membership will no longer enjoy membership rights.Based on the fact that collective proprietary rights is the legal realization form of rural collective ownership,rural collective economic organizations are the realization subjects of collective proprietary rights,and members of rural collective economic organizations are the ultimate beneficiaries of rural collective property interests,the Rural Collective Economic Organization Law has established compensation rules for the withdrawal of rural collective economic organization members.The content of the compensation rules for the withdrawal of members of rural collective economic organizations in the current law is relatively rough,so that it faces practical challenges in terms of compensation standards,compensation methods,compensation decision-making system and the risk prevention of members'withdrawal.It is necessary to systematically interpret the legal norms related to member withdrawal in the current law,establish compensation standards for member withdrawal,clarify the compensation methods for member withdrawal,refine the democratic decision-making system for member withdrawal compensation plans,and establish a risk prevention mechanism for the implementation of member withdrawal compensation rules,so as to resolve the practical difficulties of member withdrawal compensation.
