The Application Dilemma of Devolved Combined Powers in Grassroots Law Enforcement and Its Theoretical Solution
The devolution of administrative powers other than punishment power is a core initiative of grassroots law enforce-ment,and promoting the rule of law in the implementation of devolution of combined powers is an important task in the re-form stage of legalization in grassroots law enforcement.An examination of the existing legislation reveals that the number of regions that have been devolved powers and the types of devolved powers in the form of legislation are both relatively limit-ed,which poses a dilemma in terms of insufficient legal basis and narrow scope of application for the implementation of de-volved powers.The necessity of devolved powers is reflected in the administrative service,specifically in meeting the needs of people’s lives,enhancing the effectiveness of grassroots law enforcement and changing the administrative ideas of govern-ments.The introduction of the theory of implied powers provides a theoretical basis for the devolution of combined powers,and is helpful to clarify the source of its legitimacy and delimit its appropriate scope of application,which shows the func-tional orientation of service administration.According to this theory,the application of devolved powers must comply with the principles of legality,purpose,reasonableness and conformity.
