Many digital platforms adopt the implied license model to solve the massive copyright licensing problem,making it a systematic norm that restricts and shapes the digital communication and copyright circulation.But in practice,problems such as subject inequality,user’s right of choice and infringement of claims rights have also emerged.In macro view,the emergence,development and problems of copyright implied license in the digital platform reflect the challenges that the copyright legal system faced in the digital era,such as how to evaluate the value of digital labor,protect the rights and in-terests of digital content producers,and how to restrict the excessive expansion of the"private power"of the super plat-form.It can be regulated by giving full play to the restriction and balance functions of laws and regulations.We can also explore solutions such as the construction of an extended copyright collective management system at the level of system con-struction and public product supply.
