摘要
土地契约作为徽民社会生活中的组成部分,至清代已进入较为成熟化、完备化的阶段.契约中蕴含的诚信、自由与法理价值观对调节徽州土地市场秩序、维护人与自然的生态平衡以及规范社会秩序等方面发挥良好的导向作用,是徽州乡村社会稳定运行的重要基础.契约秩序的良好运行同样离不开乡村治理中各主体对契约秩序的维系.良好的乡村治理环境是契约秩序运行的重要保障,契约规则是乡村秩序稳定的基础.两者的良性互动对徽州民间社会和谐、有序发展起着一定作用.
Abstract
As an integral part of the social life of the Hui people,land contracts had entered a relatively mature and complete stage by the Qing Dynasty.The values of integrity,freedom,and legal principles embodied in the contract play a good guiding role in regulating the order of the land market in Huizhou,maintaining the ecological balance between human and nature,and regulating social order.It is an important foundation for the stable operation of rural society in Huizhou.The good operation of contractual order also relies on the maintenance of contractual order by various parties in rural governance.A good rural governance environment is an important guarantee for the operation of contractual order,and contractual rules are the foundation for the stability of rural order.The positive interaction between the two plays a certain role in the harmonious and orderly development of Huizhou's civil society.
