From"Decision-making"to"Implementation":The Legal Approach to the Division of Scienceand Technology Administrative Powers between China's Central and Local Governments
The current structure of science and technology administrative powerin China has problems such as insufficient coordination of central government,blurred boundaries between central and local governments,and selective neglect of important science and technology administrative power.In the existing response plans based on decision-makingstandards,whether it is the path of financial power formulatingadministrative power,the idea of linking the division ofadministrative power and legislative power,or the approach of division of administrative power under the governance framework,there are limitations that are difficult to overcome.In this regard,Japan's practice has the value of reference,which is characterized by full protection of local subjectivity in accordance with the"principle of sharing administrative functions",and at the same time,reconstructing the structure of scientific and technological power allocation based on implementation standards.In China.the division of authorities based on the judgement of implementation functions of science and technology administrative powers given by legal provisions and normative documents,and the supplementation of legislative system guarantee will gradually reach an equal and cooperative structure of science and technology administrative powers,which is conducive to promoting the incentive compatibility effect of central and local scientific and technological innovation.
