The community drug treatment system is based on the concept of mitigation and socialization of ad-ministrative treatment.Starting from the role of"patient"of drug abusers,and through signing the community drug treatment agreement between administrative organs and community drug abusers,the correction and education of drug abusers can be realized with the participation of diversified subjects in society.Community drug treatment a-greement is an important carrier for the implementation of community drug treatment system.However,due to the generalization of administrative power in practice,the community drug treatment system has gradually become a pre-emptive or alternative means of institutional treatment.To analyze the reasons,on the one hand,the community drug treatment agreement itself is inadequate;on the other hand,the supervision and restriction of administrative power is lacked.Therefore,we should improve the specific content of community drug treatment agreement,clarify the legal attribute of community drug treatment agreement,and establish the supervision and restriction mechanism of judicial power over executive power with community drug treatment agreement as a"bridge",so as to promote,as the social-ized treatment,the development of community drug treatment system.
