数字时代个人数据区分保护问题

摘要
数字时代特有的风险性,突显个人数据保护的重要价值,而对其区分保护是解决个人数据利用和保护之间衡平的有效方案.个人数据认定已由单独且抽象的人格权、附属的财产性权益向综合性权利转化.个人数据保护应秉持"以人为目的"的发展理念,重视个人数据财产性等价值,当个人数据受到侵害后给予综合性保护,非个人数据可选择财产性权益保护模式,而个人数据和非个人数据交融且无法分割时应统一适用个人数据保护类法律.
Abstract
The special risks in the digital age highlight the important value of personal data protection,and the differentiated protection of personal data is an effective solution to achieve the balance between the use of personal data and its protection.The identification of personal data has been converted from the single and abstract personali-ty right and subordinate property right to the comprehensive right.To protect the personal data,we should adhere to the development concept of"regarding the person as the purpose",and attach importance to the values such as the personal data property etc.When the personal data is infringed,the comprehensive protection should be given.Non-personal data can choose the protection mode of property right,and when the personal data and non-personal da-ta blend into each other and cannot be separated,the law of personal data protection should be applied uniformly in this condition.
