摘要
民法典以其基本法律的属性对我国法治政府建设起着规范作用.法治政府在内涵建设上需要秉持人民至上的价值理念、权利保障的基本要求、依法行政的运行规则、公私协同的治理模式.民法典是法治政府建设的基本法律依据,是正确处理政府与市场、公法与私法的关系的标尺.它强化了法治政府建设的价值目标,推动着良法善治的政府治理实现.当前,法治政府建设对民法典的适用需要进一步解决民事主体权利保护,公权与私权、政府与市场的协调融合,以及社会公序良俗维护等方面的问题.因此,法治政府建设需要以继续完善立法、规范行政行为、遵从民法优先的冲突解决机制等方面作为民法典适用的关键.
Abstract
Civil Code,with its basic legal attributes,plays a normative role in the construction of the law-based government in China.The law-based government,concerning its connotation construction,should uphold the value of putting the people first,the basic requirement of right protection,the operation rule of administration ac-cording to law,and the governance mode of public-private coordination.The Civil Code is the basic legal basis for the construction of the law-based government,and the criterion for correctly handling the relationship between the government and the market,and between public law and private law.It strengthens the value and goal of the con-struction of law-based government,and promotes the realization of government management with good law and good governance.At present,the construction of the law-based government applying the Civil Code needs to further solve the problems such as the protection of civil subjects'rights,the coordination and integration of pubic right and private right and of government and market,and the maintenance of social public order and the good customs etc.Therefore,as the key to the application of Civil Code,the construction of law-based government should do well in the following aspects:continuing to improve the legislation,standardizing the administrative behavior,complying with the conflict resolution mechanism that taking the civil law as the priority.
