摘要
刑法修正案(八)第四十七条所指的罪名需进一步分解,其罪状表述需进一步规范.非法占有型采矿罪的刑罚设置需更好地适应抢劫矿产罪、抢夺矿产罪、盗采矿产罪之社会危害性.刑法修正案(八)第四十七条所指的罪名可分解为抢劫矿产罪、抢夺矿产罪、盗采矿产罪,进一步规范刑法修正案(八)第四十七条的罪状表述,准确把握抢劫矿产罪、抢夺矿产罪、盗采矿产罪的犯罪构成.在犯罪客观方面,正确理解情节严重的内涵.为了更好地与抢劫矿产罪、抢夺矿产罪、盗采矿产罪之社会危害性相适应,进一步调整刑法修正案(八)第四十七条设定的刑罚.
Abstract
The name of crime in article 47 of The Amendment(ⅷ)of Criminal Law needs to be further sepa-rated,and the count of the crime needs to be further standardized.The penalty setting of the crime of illegal posses-sion of the mining should better adapt to the social harm of looting,seizing and stealing the mineral resource.The name of crime in article 47 of The Amendment(ⅷ)of Criminal Law can be further separated into the crime of loo-ting minerals,the crime of seizing minerals,and the crime of stealing minerals,so as to further standardize the count of the crime in article 47 of The Amendment(ⅷ)of Criminal Law,and accurately grasp the criminal constitution of looting minerals,seizing minerals,and stealing minerals.In the objective aspect of the crime,it is necessary to cor-rectly understand the connotation of the serious circumstances.In order to better adapt to the social harm of of the crime of looting,seizing,and stealing minerals,it is necessary to further adjust the penalty set by the article 47 of The Amendment(ⅷ)of Criminal Law.
