The modest and Restrained principle of criminal law contains the concepts such as austerity,supple-mentation,and frugality,which is an important principle of contemporary criminal law.In the crimes committed by relatives,the duality of the crime infringing upon the social relationship,the particularity of the criminal's subjec-tive malignancy,and the contradiction of the victim's demands,these factors determine the complexity and difficulty in legislation,judicature,and law enforcement.Scientific conviction and sentencing of crimes committed by relatives not only contribute to the implementation of the criminal law,but also contribute to the construction of family ethical relations.Therefore,according to the modest and restrained principle of criminal law,it is necessary to classify the crimes committed by relatives in legislation and treat them differently in judicature,which may maximize the effec-tiveness of the criminal penalty of inter-relative crimes.
