海域使用金征收标准分析与评价

海域使用金征收是实行海域有偿使用制度的重要环节,国家和地方通过制定标准来实施有偿使用征收.2002年以来,海域使用金年度征收金额总体呈现上升趋势.国家制定的新版征收标准较前一版有所提高,其中填海最为明显,反映出国家严格管控围填海的要求.地方制定的征收标准存在地域性差异,制定时应考虑与周边省份标准相衔接.市场化出让方式能获得更多的海域使用金收益,有利于保障自然资源资产所有者的权益.建议从完善海域使用金动态调整机制、修订相关标准规范、出台立体分层设权项目海域使用金征收办法、健全市场化出让制度等4个方面健全海域有偿使用制度.
Abstract
The collection of sea area use fee is an important segment in the implementation of the paid use system of sea areas,and the state and local governments implement the paid use system of sea areas by formulating standards.Since 2002,the annual collection amount of sea area use fee has shown an overall upward trend.Compared with the previous version,the new collection standards formulated by the state has been improved,with the most significant increase observed in reclamation fee,reflecting the state's strict control of reclamation.There are regional differences in the local collection standards,so it should be considered to link up with the standards of neighboring provinces.Market-oriented transfer can obtain more revenue from sea area use fee,which is conducive to protecting the rights and interests of natural resource asset owners.It is suggested that the system of paid use of sea areas should be improved from four aspects:improving the dynamic adjustment mechanism of sea area use fee,revising relevant standards and specifications,issuing the collection method of sea area use fee for three-dimensional layered right-setting projects,and improving the market-oriented transfer system.
