摘要
长期以来,我国沿海地区围填海造地管理普遍存在海域与土地制度不衔接的情况.通过梳理国家层面有关法律法规、规章制度等对围填海造地管理涉及环节与主要内容的规定,再结合地方实践,以广东省为例,分析围填海造地管理中海域与土地制度主要存在管理程序不衔接、规划与用途管制不衔接、使用金管理不衔接、相关技术规范不衔接等4个方面的问题.基于公共池塘理论与博弈合作理论,建议从国家层面进一步完善政策制度供给,统一法律法规、统一换证方式与程序、统一规划与用途管理、统一用地用海要素市场与统一技术规范.
Abstract
For a long time,there has been a general lack of convergence between marine reclamation and land management in China coastal areas for long.In this study,we card the relevant national laws,regulations and rules involved in the connection between marine reclamation and land management,and analyze the discordances between reclamation and land management system based on the local practice of Guangdong Province,involving management procedures,planning and use,use fund management and technical specifications.Based on the theories of common pond and game cooperation,some suggestions are put forward to further implement the land-sea integration strategy,which mainly include integrating laws and regulations,integrating procedures and methods for certification replacement,integrating planning and use right management,integrating land&sea use market,and integrating technical specifications.
