On the Legal Protection of Tea Intangible Cultural Heritage in China
Tea intangible cultural heritage is an important component of China's outstanding traditional culture,and its legal protection has multiple meanings such as historical inheritance,cultural transmission,and industrial development.At present,there are specific problems in the legal protection of tea intangible cultural heritage through the cultural law and intellectual property law,such as insuf-ficient coordination among law-making subjects,failure to form a joint force for the protection of intangible cultural heritage,and lack of protection mode of generic names.Based on the holistic perspective,it can be seen that the protection of tea intangible cultural heri-tage in China has failed to implement the concept of the cultural rule of law,and it is urgent to further optimize the cultural norm sys-tem and establish a synergistic effect between laws.It is suggested that the ideological guidance of cultural rule of law on tea intangible heritage should be realized in the concept dimension,the cultural law governance of central and local norms on tea intangible heritage should be perfected in the normative dimension,and the cooperative protection of tea intangible heritage by multi-branch law should be explored in the practical dimension.
