On the System Construction of the Compulsory Reclamation System of Homestead Land Through Review and Approval——On the Application of Article 66(1)of The Land Management Law
The compulsory recovery of homestead land directly affects the scope of paid with-drawal of homestead land.However,due to the incompleteness of the determination of the effectiveness of recovery,the classification criteria should also be based on the review and approval that has a substan-tial impact on it.Among them,the review and approval as a constituent fact is directly related to the for-mation and change of the relationship between the recovery of homestead land,and can have the legal ef-fect of eliminating the right to use homestead land;As a confirmation of factual review and approval,it only confirms whether the right to use the homestead has been extinguished,without determining or di-rectly affecting changes in the right to use the homestead.Based on this,two types of review and ap-proval constitute the basic types of the compulsory recovery system of homestead land,thus achieving the systematic construction of this system.
