Research on Legislative Perfection of the Risk Regulation of PPP
As a mode of supplying public goods and services by the cooperation of government and social cap-ital,PPP basically aims to insure sustainable supply of general public goods or services by public and private coope-ration.Win-win cooperation is the bilateral common value orientation.The legislation of PPP's risk regulation should tightly revolve around the risk node during the process of carrying out PPP,while confirming the basic prin-ciples that should be observed during legislation as well as establishing and improving relative legal systems.On the premise of adhering to the principle of rule of law,the legislative perfection of PPP's risk regulation should allocate the legislative right of regulating PPP's risk according to law,and focus on establishing and improving government franchising legal system,as well as improving the government supervisory system concerning the risk of PPP.We should try to realize organic combination of innovating legislation and deepening reform,establish relatively inde-pendent institute of PPP's risk regulation,innovate the specific mechanism of PPP's risk regulation,realize fair and rational allocation of the risk,in order to prevent and defuse the possible risk of PPP,and promote PPP to better provide greater well-being for social public.
