Further Exploration of the Anti-Monopoly Law Regulation Path for Platform Self-Preferential Treatment
Platform self-preferential treatment is a new type of behavior that has emerged with the development of platform economy.Although the current anti-monopoly law may regulate it,there are still certain difficulties and challenges that need to be overcome and solved.In view of the complex nature of such conduct and the difficulty in identifying its impact on competition,it is proposed to regulate it by classification,which would be consistent with the zero per cent self-preference for abuse under the anti-monopoly law,it belongs to the regulation category of refusal to deal,differential treatment,tying and unreasonable trading conditions attached thereto;for some abusive behaviors that do not comply with anti-monopoly laws,they shall be treated as independent abusive behaviors and included in relevant anti-monopoly guidelines or regulations for specific regulation.Meanwhile,we should strengthen the ex-ante and ex-post regulations of the platform's self-preferential treatment,establish a complete mechanism of industry self-discipline,and maintain the fair competition order of the platform.
