对于涉及商业秘密人员离职是否可以实行脱密期管理,我国现行劳动法律并没有明确规定,当前法律实务中对商业秘密脱密期是否合法存在诸多争议。随着当代社会知识经济的飞速发展,越来越多的用人单位重视对本单位知识产权的保护,加强运用脱密期、竞业限制等多种方式来保护本单位的商业秘密。加强劳动关系中商业秘密的脱密期实务管理,从而在用人单位商业秘密保护与劳动者就业自由之间实现有效平衡。
Discussion on the Release Period of Trade Secret
The current labor law of our country does not stipulate clearly whether the period of demurrage can be implemented for the employees who leave the company,and there are many disputes about whether the period of demurrage is legal in the current legal practice.With the rapid development of Knowledge Economy in the Contemporary Society,more and more employers attach importance to the protection of their own intellectual property rights,and strengthen the protection of their own business secrets by various means,such as release period,competition restriction and so on.We must attach great importance to the practical management of the trade secret release period in labor relations,and achieve an effective balance between the protection of the employer's trade secret and the workers'employment freedom.
