共富视角下宅基地旅游化盘活的法律风险研究——基于温州典型案例分析

乡村旅游的兴旺离不开土地资源的科学开发与高效利用。随着宅基地"三权分置"改革的不断深化,宅基地的盘活利用模式不断创新,为乡村旅游的发展提供了重要的土地要素,但同时也引发了一些法律风险。通过温州典型宅基地旅游化盘活案例研究,量化不同模式下的法律风险,提出应明确宅基地经营性用途、完善利益分配机制、增强集体经济组织治理能力和规范宅基地流转程序的建议,以期助力农村农民实现共同富裕。
Research on the Legal Risks of Revitalizing Homestead Tourism from the Perspective of Common Prosperity—Based on the analysis of typical cases in Wenzhou
The prosperity of rural tourism cannot be separated from the scientific development and efficient utilization of land resources.With the continuous deepening of the"separation of three rights"reform of homestead land,the revitalization and utilization mode of homestead land is constantly innovating,providing important land elements for the development of rural tourism,but at the same time,it has also triggered some legal risks.Through the study of typical cases of tourism revitalization of homesteads in Wenzhou,the legal risks under different modes are quantified,and suggestions are proposed to clarify the operational use of homesteads,improve the mechanism of benefit distribution,enhance the governance capacity of collective economic organizations,and standardize the procedures for homestead transfer,in order to help rural farmers achieve common prosperity.
