警察执法生态的回归与展望

摘要
从生态学的理论视角来研究警察执法生态问题,是公安理论研究领域一个全新的前沿理论课题,也是警察执法实践中需要正视并加以探讨的问题。警察执法行为从启动、调查、决定、执行等整个流程的各个步骤、各个阶段、各个环节都离不开执法土壤、场所、环境、条件、对象等诸方面的配合与支持,警察执法生态是指警察执法行为与执法环境之间相互依存、相互联系、相互作用、互为影响的互动平衡状态,它制约和影响执法行为的效果与质量。社会矛盾与利益冲突是导致警察执法生态失衡的根本原因,行政干预是导致警察执法生态失调的重要原因,公民法制观念的缺失是导致警察执法生态失序的原因,暴力抗法与暴力袭警是导致警察执法生态失控的原因。警察执法系统只有与外部环境系统始终保持协调互动的平衡关系,才能发挥警察执法行为的最佳效能。
Abstract
Studying the police law enforcement ecology from the perspective of ecological theory is not only a new forefront subject of the public security theoretical research,but also a problem that should be faced and discussed in the practice of the police law enforcement.The entire process of the police law enforcement is inseparable from the cooperation and support of the soil,place,environment,condition,and object of the law enforcement.The police law enforcement ecology refers to the interactive equilibrium of the interdependent,interrelated,interactive and mutual affected relations between the law enforcement and its environment.It constraints and affects the effect and the quality of the law enforcement.Social contradictions and conflicts of interests are the root causes of the disequilibrium of the law enforcement ecology.The administrative intervene is the main reason of the maladjustment of the law enforcement ecology.The citizens＇ lack of legal concept leads to the disorder of the law enforcement ecology.Violent resistance to law and violent attack towards police result in the law enforcement ecology＇s being out of control.Only when the police law enforcement system keeps interactive balance with the outside environment system,can the police law enforcement play its best performance.
