摘要
国外许多国家已经将恶意欠薪入罪,我国在除刑法之外的其他部门法中也对恶意欠薪行为作出了相关规定。恶意欠薪入罪迎合了现实需要,有其充分的理论依据,对规范劳资关系、稳定社会秩序、促进经济发展起到举足重轻的作用,体现了法律的公正价值、秩序价值和效率价值。针对入罪后适用的法律问题,应当对具体罪状作出相应的界定。
Abstract
Malicious arrearage of salary is criminalized by many foreign country,and in China,it also be set in the law except the criminal law.Criminalized the malicious arrearage of salary comes with the actual needs;especially it gives a theoretical proof for regulating working procedure,maintaining social order and promoting economic development.Adding of the crime of malicious arrearage of salary embodies the law whose benefits of Justice,order and effect.For the law problems after criminalization,we should judge to concrete crime.
