摘要
社区矫正是我国宽严相济刑事政策＂宽＂的体现,而其本身也存在着如何把握＂宽＂的度以及如何与＂严＂进行衔接的问题。具体到矫正理念方面,就是要解决福利性和惩罚性如何相协调的问题;在运行模式方面,就是要解决国家主导还是社会主导的问题;在外延界定方面,就是要解决当前社区矫正的法律定位能否调整以及如何调整的问题;在入矫依据方面,就是要处理好罪责标准和社区标准的关系问题。
Abstract
Community correction reflects the ＂mercy＂ of our criminal policy of temper justice with mercy.And there are problems of how to handle the degree of ＂mercy＂ and how to combine it with the ＂temper＂ suitably.Specifically,it is to solve the problem of how to reconcile the benefit and penalty.The problem to be solved in operation model is whether it is state-led or society-led.In the area of extension definition,it is to solve the problem of how to view and adjust the legal status of community correction.In terms of the standard of bringing into correction,it is to solve the problem of how to deal with the relationship between guilt standard and community standard.
