Analysis of Adjudication Standards in Virtual Currency Lending Cases——An Empirical Analysis Based on 133 Judgments
Virtual currency,as an asset with both commodity and value attributes,provides a convenient trading,global circulation,and decentralized new circulation channel in the market.The targets of private lending are becoming diversified,and disputes related to virtual currency lending are constantly emerging.However,in judicial practice,there is no unified standard for adjudicating virtual currency lending cases,and the judicial outcomes appear to be polarized.To safeguard the legitimate rights and interests of civil subjects,it is urgently needed to analyze the current judicial adjudication of virtual currency lending cases from both a macro perspective of data synthesis and a micro perspective of examining adjudication paths.The study aims to explore the core issues behind the divergent judicial decisions in virtual currency lending cases and conduct legal analysis on the divergence of opinion regarding whether virtual currency lending relationships should be legally protected from the perspectives of legal concepts,legal relationships,and social consensus.Ultimately,the study proposes a judicial standard of general circumstances support restitution,exceptional circumstances are the exception'.
