摘要
没收财产作为我国刑事附加刑的一种,在打击严重刑事犯罪方面发挥着重要的作用.但由于立法的不完善和司法实践的缺乏,对于没收财产范围、为犯罪分子及其被扶养家属生活费用预留、执行顺序等实务问题,各地法院做法不一,影响了没收财产效能的发挥.本文从司法实务角度出发,对没收财产对象的表现形式、被扶养家属的范围、必需生活费用预留的标准、责令退赔和没收财产并存的处理、赃款赃物收益的处分、案外人权益保护等方面进行了研究探讨,为没收财产执行提供了有益的借鉴.
Abstract
Confiscation of property,as one of the additional criminal penalties in China,plays an important role in combating serious criminal offenses.However,due to the imperfection of legislation and the lack of judi-cial practice,local courts have different practices on practical issues such as the scope of property confiscation,the reservation for the living expenses of criminals and their dependents,and the order of execution,which af-fects the performance of property confiscation.From the perspective of judicial practice,this paper studies and discusses the manifestations of the object of property confiscation,the scope of dependents,the standard of neces-sary living expenses set aside,the treatment of the co-existence of ordered returns and compensation and confis-cated property,the disposition of the proceeds of stolen money and stolen goods,and the protection of the rights and interests of outsiders,etc.,which provides useful references for the execution of property confiscation.
