高校民法学教育中案例研习方法的创新实践路径

我国高校民法学教育中,传统的案例教学法并未从本质上改变既有的教师主导型的"经院式""灌输式"教学模式和学生被动的"接受型"的学习模式.为破解这一难题,建构出一套区别并进步于传统民法学实践课程模式的创新型案例研习方法体系,分为初级、中级和高级三个阶段:第一阶段是以鉴定式案例研习方法来提升学生对法律规范和事实的体系分析能力;第二阶段是以论辩式案例研习方法来提升学生围绕争点的对抗论证能力;第三阶段是以诊所式案例研习方法来提升学生对真实案例的实战处理能力,最终实现提升学生核心职业能力的培养目标.
The Innovative Practice Path of Case Study Method in Civil Law Education
In civil law education in Chinese colleges and universities,the traditional case teaching method has not fundamentally changed the existing teacher-led"scholar-style"and"infusing"teaching mode and stu-dents'passive"receiving"learning mode.In order to solve this problem,a set of innovative case study method system is constructed,which distinguishes and improves the traditional civil law practice course mode.It is divid-ed into three stages:primary,intermediate and advanced stage.The first stage is to improve students'systematic analysis ability of legal norms and facts by using the model case study method.In the second stage,argumenta-tive case study is used to improve students'ability of argumentative argumentation.In the third stage,the clinical case study method is used to improve students'ability to deal with real cases,and finally achieve the training goal of improving students'core vocational ability.
