摘要
工伤保险是社会保险制度的重要组成部分,而工伤互助保险顺应"工伤保险社会保障化"趋势,践行"以人民为中心"的发展思想,并且拥有制度空间、试点实践和先行经验作为制度支撑,因此具有必要性与可行性,可作为政策性工伤保险的有效补充.本文在梳理中国工伤保险制度发展历程和存在问题的基础上,以宁海商会工伤互助保险为例,分析工伤保险中相互保险模式的探索成效与面临的困境,并在此基础上从完善顶层设计、优化市场环境、构建行业生态三个方面提出进一步完善工伤保险制度体系的几点建议,包括相关规范性文件应当对制度构成要件和配套措施予以阐明;促进互助保险组织发展;提升工伤保险行业服务能力等.
Abstract
Work injury insurance is an essential part of the social insurance system,and work injury mutual aid insurance aligns with the trend of"social securitization of work injury insurance",adheres to the"people-centered"development philosophy,and is supported by institutional frameworks,pilot programs,and early experiences.Therefore,it is both necessary and feasible,serving as an effective supplement to statutory work injury insurance.Based on a review of the development history and challenges of China's work injury insurance system,this paper analyzes the effectiveness and challenges of the mutual insurance model through a case study of the Ninghai Chamber of Commerce Work Injury Mutual Aid Insurance.Building on this analysis,the paper offers recommendations to improve the work injury insurance system from three perspectives:Improving top-level design by clarifying the essential components and supporting measures in relevant regulatory documents.Optimizing the market environment to support the development of mutual insurance organizations.Building an industry ecosystem to enhance service capabilities in the work injury insurance sector.
