The Legal Connotation and Institutional Implementation of Medical Liability Insurance from the Perspective of Risk Society
Medical activities are always accompanied by risks.Social insurance is based on the concept of risk prevention and sharing.The medical liability insurance system is an inevitable choice that takes into account the protection of patients'rights and interests and medical development.To some extent,it can improve the relationship between doctors and patients.In the process of the implementation of medical liability insurance system in China,there are some problems such as insufficient compulsory medical liability insurance,incomplete coverage of insurance subjects,insufficient correspondence and lack of detailed and comprehensive statistics of insurance rates.Based on the current relevant national laws,administrative norms and local exploration practice,it is pointed out that compulsory medical liability insurance should be implemented through improving legislation,strengthening the effective correspondence of medical liability insurance,and setting insurance rates reasonably,so as to effectively exert the risk sharing ability of medical liability insurance system,protect the rights and interests of patients,and effectively promote the construction of healthy China.
