摘要

数字化时代,数字技术的发展改变着刑事司法的样态,给司法证明带来"赋能"与"转型"双重效应.数字技术使得司法证明呈举证多态化、质证科技化和认证智能化的态势.应从技术和法律两个维度分析数字技术赋能刑事司法证明的运作路径.通过构建一个理性主义框架,厘清数字技术赋能刑事司法证明的总体定位,并从"经验与科学""权力与权利""程序与实体"三重维度对司法证明活动来进行具体分析.刑事司法证明隐患的关键在于生物算法和数字算法互嵌,应从多元求真的角度入手打破二元互嵌窘境,促进数字技术赋能与传统印证模式形成优势互补,从而促进案件事实认定科学化.

Abstract

In the digital age,the development of digital technology changes the pattern of criminal justice,bringing the dual effect of"empowerment"and"transformation"to judicial proof.The digital technology makes the judicial proof present the situation of multi-state evidence,technology of cross-examination and intelligent certification.The operation path of digital technology ena bling criminal justice proof should be analyzed from two dimensions of technology and law.This paper attempts to construct a rationalist framework,clarify the overall positioning of digital technology enabling criminal justice proof,and make a concrete analysis of judicial proof activities from the three dimensions of"experience and science","power and right","procedure and entity".The key to the hidden danger of criminal justice proof lies in the interlocking of biological algorithm and digital algorithm.We should break the binary interlocking dilemma from the perspective of multiple truth-seeking,and promote the complementary advantages of digital technology enabling and traditional confirmation mode,so as to promote the scientific identification of facts.
