Legal Regulation and Optimization Path for the Supervision of Cross-border Data Flows in China
Data generates huge value in circulation and is an emerging production factor for social and economic development.The cross-border flow of data has become the norm.Countries around the world have different theories and regulatory models for cross-border data flow based on their own interests.The"Data Security Law"focuses on prominent issues in the field of data security,and together with relevant laws and regulations,forms the legal framework for the supervision of cross-border data flows in my country.Based on the current legal regulations for cross-border data flow supervision,there are problems such as vague definitions of data classification and classification,imperfect security assessment rules,lack of subsequent supervision and protection,and overly strict localization measures.It is proposed to optimize data on the basis of adhering to the principle of data sovereignty.Cross-border rules promote the orderly and free flow of data in accordance with the law while ensuring data security,strengthen international cooperation,participate in global data governance,and promote high-quality development of the digital economy.
