未成年人犯罪的诱因与"穿透性"治理——以家庭暴力侵害未成年人案件为视角

未成年人处于人格发展阶段,家庭暴力消解家庭功能,在心理上驱动未成年人人格变态导向,并可能内化为犯罪心理,导致未成年人犯罪与反社会人格产生;在社会层面,家族传统的封闭观念又强化了家庭暴力的隐蔽性特征.由于"亲权"观念的固化以及未成年人求助难、外界干预积极性低、公权力介入范围狭窄等制度性缺失,公权力难以介入家庭直接实施干预.由此,应坚持以未成年人为主体的原则,通过有针对性地赋予未成年人人身安全保护令申请人主体资格、完善家庭暴力认定标准、明确强制报告义务人及其责任等制度优化,规范未成年人家庭暴力案件处理流程,积极构建严密的公权力介入干预网络,从而实现未成年人犯罪的"穿透性"治理.
On Inducement of Juvenile Delinquency and"Penetrating"Governance:From the Perspective of Domestic Violence against Minors
Minors'personalities are in the developing stage.The occurrence of domestic violence will erode family functions.Psychologically,it drives the abnormal orientation of minors'personalities and internalizes it into criminal mentality,resulting in the emergence of criminal and antisocial personalities.Socially,it seals the family through the inherent concept of familism and enhances its covert characteristics.However,due to the consolidation of the concept of"parental authority"and the triple institutional deficiencies of minors'difficulty in seeking help,the low enthusiasm of external interference,and the narrow scope of public power intervention,it is difficult for public power to directly intervene in families.To curb the potential crimes thus induced,the principle of taking minors as the main body should be adhered to.System optimizations such as granting minors the subject qualification of applicants for personal safety protection orders,perfecting the identification standards of domestic violence,and clarifying the compulsory reporting obligors and their responsibilities should be carried out in a targeted manner.This is to standardize the handling process of domestic violence cases involving minors,construct a strict intervention network of public power,and achieve the"penetrating"governance of juvenile delinquency.
