On the Enhancement of the International Influence of the Rule of Law on Anti-Corruption,Fugitive Repatriation and Asset Recovery
In recent years,China has adhered to the application of the rule of law thinking and the methods in combating corruption,and has continuously improved the criminal law system against corruption.The newly passed Amendment(Ⅻ)to the Criminal Law of the People's Republic of China has revised and improved provisions on the punishment of internal corruption offenses in private enterprises as well as bribery offenses.Furthermore,the synergy between supervisory law enforcement and the criminal justice system has been reinforced.Through taking firm action to"take out tigers","swat flies"and"hunt down foxes",China has achieved new breakthroughs in cross-border fugitives repatriation and asset recovery,which fully demonstrates its governance capacity and the strengths of its state systems.However,for var-ious reasons,there are still misunderstandings or even misinterpretations of China's anti-corruption fugitive repatriation and asset recovery in the international community,which not only creates difficul-ties in criminal justice and law enforcement cooperation in fugitive repatriation and asset recovery,but also undermines China's international impact and national image on anti-corruption governance.The international influence of anti-corruption governance is built on successful experiences as its factual foundation,with international cooperation as a crucial path and international anti-corruption dissemina-tion as a key medium.At present,while leading international cooperation in anti-corruption with suc-cessful practices in fugitive repatriation and asset recovery,it is still necessary to reinforce law-based and standardized framework of anti-corruption fugitive repatriation and asset recovery.Through effec-tively integrating anti-corruption measures with anti-money laundering efforts by harnessing big data,the success rate of fugitive repatriation and illicit asset recovery will be enhanced.Moreover,there re-mains an imperative to innovate the philosophies and methods of external dissemination of anti-corrup-tion work.Such endeavors will hopefully enhance the international influence of China's anti-corruption governance,and ultimately promote the development of a more impartial and reasonable international anti-corruption governance system.
