论韩非子"因情而治"的内在逻辑及黄老学渊源

韩非子的"人情"主要指人在处理人己物我关系时表现出的趋利避害的真实情态。其"因情而治"的治道设计有助于君主顺应并利用人们趋利避害的行为趋向和心理定势,在掌控和控御臣民之"人情"共性的基础上,高效便捷地使政治事务和社会生活整齐划一,既可以克服君主德智不足的弊端,又能够实现以简驭繁的高效治理。"因情而治"的内在要求是君道无为而臣道有为,臣民各处其宜、皆用其能,在臣民各守其分、各司其职、各尽其能中为国家贡献智慧和才干,君主则在臣民之具体作为中保持"无为"姿态。韩非子"因情而治"治道方略的理论渊源正在黄老那里,韩非子将黄老立足"天—地—人"宏大视野下展开的"因情而治"收缩至君臣关系的维度以佐助强力统治。
The internal Logic of Han Feizi's Governance According To Humanfeelings and the origin of Huang Lao's Theory
Han Feizi's human feelings mainly refer to the true modality of seeking advantages and avoiding disadvantages when dealing with the relationship between people and things.The design of governance based on emotion helps the monarch to conform to and make use of people's behavior and psychological tendency of seeking advantages and avoiding disadvantages.On the basis of controlling and controlling the human feelings of the subjects,the political affairs and social life can be unified efficiently and conveniently,which can not only overcome the disadvantages of the monarch's lack of morality and intelligence,but also realize the efficient governance of simplicity and complexity.The inherent requirement of governing by emotion is that the monarch does nothing and the minister does something.The subjects use their abilitieseverywhere,and contribute wisdom and talent to the country in the performance of their duties.The monarch maintains a"inaction"attitude in the specific actions of the subjects.The theoretical origin of Han Feizi's rule by emotion is Huang Lao Taoism.Han Feizi shrinks Huang Lao's rule by emotion based on the grand vision of heaven-earth-people to the dimension of the relationship between monarch and minister to assist in strong rule.
