China's traditional medical system,the main factor of the loss of patients'autonomy is the neglect of patients'individual will.In order to protect the patient's free will and life dignity,the author discusses the qualifications and decision-making scope of the living will maker,and how to perfect the legal procedure of the living will implementation,and the feasible path of the prudent duty and patient autonomy of the medical institution,which is helpful to the research and supplement of the legislation of the living wills,and to the protection of the patient autonomy and the prevention of legal risks.
