非法基因编辑罪中"情节严重"的教义学展开

摘要
刑法修正案(十一)中将非法基因编辑行为单独设罪设刑,并且将"情节严重"作为本罪成立条件,但目前并未对"情节严重"作出明确规定,法律解释学的方法也难以明晰本罪"情节严重"的内容."情节严重"在犯罪论体系中的定位应当是类构成要件复合体,因此,本罪中的"情节严重"应当具备行为要素、结果要素、主观要素以及其他概括性要素.
Abstract
The Amendment to the Criminal Law(Ⅺ)separately criminalizes illegal gene editing behavior and makes"serious circumstances"a condition for the establishment of this crime.However,there is currently no clear provision for it,and it is difficult to clarify the content of"serious circumstances"in this crime through legal hermeneutics methods.The positioning of"serious circumstances"in the criminal theory system should be a composite of class composition elements.Based on this,"serious circumstances"in this crime should have elements of quantity,means,object,result,subjective,and other general elements.
