The rapid development of genetic technology and the continuous deepening of human genetic research have brought great risks and challenges to the protection of individual gene privacy.Because the gene privacy of natural person is inherent and unique,the protection of privacy and personal information in the"Civil Code"cannot cover all its contents.However,the openness of the personality rights system in the"Civil Code"provides a new idea for the protection of gene privacy.The new personality attribute of right of gene privacy is demonstrated through three level which are right attribute,value basis and practical demand.On this basis,we can clarified the subject,object,contents and boundary of right of gene privacy,so that it will help to provide a more comprehensive theoretical basis for the protection of right of gene privacy and prevent the abuse and generalization of the right.
