Three Dimensions of Rule of Law in China:Obstacles and Solutions
From"a country under rule of law"to"China under rule of law",China's construction of her socialist rule of law has been transformed and upgraded yet there is still no general consensus among Chinese legal aca-demics as to what kind of rule of law China should build and how to build it.A lack of consensus means a lack of adequate discourse system.In order to revitalize the concept of rule of law in the new historical era,clear the obstacles to an intellectual consensus on rule of law,and continue to enrich,develop,and solidify the theoretical foundation of China's rule of law in practice,contemporary Chinese legal academics need to focus on three basic dimensions:correcting the tendency of"partiality"in legal transplantation,strengthening the understanding of the actual operation of rule of law,and balancing the three types of concepts of rule of law.Based on China's spe-cific historical-political structure,and"using China as a method",we should endeavour to break down the deep-rooted"monistic universalist view of rule of law"and construct a new discourse system characterized by Chi-nese subjectivity so as to enrich the practical wisdom of rule of law for the entire humanity.
