Abstract
Currently,the legislation of The Mental Health Act 1983 (amended 2007) and The Mental Capacity Act 2005 have been used widely to protect the mental disorder patient' s rights.This essay will critically analyse mental disorder and models of capacity related to the case submitted,then focus on analysis of the Mental Capacity Act 2005,The Mental Health Act 1983(amended 2007) and related codes of practice.
