摘要

劳动关系合意在确认劳动关系纠纷中起着非常关键作用,但受制于传统劳动关系认定标准的影响一直未受到关注.近些年来随着新业态用工确认劳动关系纠纷明显增加,劳动关系合意运用引发了广泛讨论.对劳动关系合意在确认劳动关系纠纷中的作用及意义、非典型用工模式中劳动关系合意运用现状、存在问题以及完善劳动关系合意运用对策进行研究,以期能促进裁审机关规范认定劳动关系行为,探索构建新业态平台用工劳动关系认定新规则.

Abstract

Labor relations agreement plays a crucial role in resolving labor disputes,but it has often been overlooked due to the influence of traditional labor relations identification standards.In recent years,there has been a significant increase in labor disputes related to the confirmation of newemployment forms,which has sparked widespread discussion on the consensual use of labor relations.This research will focus on the role and significance of labor relations agreements in confirming labor disputes,the cur-rent situation and existing issues of labor relations agreement in atypical employment models,and strate-gies to improve the utilization of these agreements.The aim is to promote the standardization of labor re-lations identification by arbitration authorities,and to explore the development of new business platforms and new rules for labor relationship recognition.
