On the Path of Land Management Right Registration under the Background of Rural Revitalization
The right to manage land can be derived from two paths:the right to manage land and the owner-ship of collective land.However,it is not the dependent relationship with those two types of rights,but an in-dependent property right that can obtain equal protection.In the context of the"three rights"in rural areas,the registration of land management rights is based on China's actual national conditions,and is a path to sci-entific construction of a rural land rights system.The path of registering land management rights as property rights and the path of property registration not only meet the internal requirements of rural land reforms,but also fit China's ongoing unified real estate registration system.The design of the path of registering land management rights as property rights has practical operability in practice,with a solid institutional founda-tion and legal safeguards.The normative basis of the path of registering land management rights as property rights can be demonstrated through explaining its independent property attributes,usufruct attributes,the sys-tem of property rights structure,as well as its adaptability to registration.
