An anti-arbitration injunction is an order issued by a court to prohibit an upcoming or ongoing arbitration proceeding.The application of anti-arbitration injunction can exclude illegitimate and unreasonable arbitration procedures,but if it is applied indiscriminately,it will cause confusion of legal order,endanger the confidence of the parties in arbitration,and is not conducive to the smooth settlement of disputes.Combined with the practice of judicial review of arbitration in Pakistan,it can be found that the application trend of anti-arbitration injunction in Pakistan is constantly expanding.From the perspective of legality,the anti-arbitration injunction approved by Pakistani courts has no more direct statutory basis,and most of them are issued on the basis of the extended rights of the law;From the perspective of reasonableness,the discretion of the Pakistani court in the anti-arbitration injunction directly leads to the ambiguity of the reasons for the approval of the anti-arbitration injunction.Arbitration is an effective way to resolve commercial disputes between China and Pakistan,and relevant parties in China should actively take reasonable measures in advance by"ensuring the validity of the arbitration agreement"and other effective ways to avoid legal risks that may be incurred due to the uncertainty of the anti-arbitration injunction.
