Liability of Educational Institutions for Tort in Student Injury Accidents——An Empirical Analysis Based on 110 Judgment Documents
Educational institutions have the legal responsibility to educate,manage,and protect the safety of students.If educational institution fails to fulfill its corresponding responsibilities fully,resulting in the occurrence of student injury accidents,it should bear the corresponding tort liability.This study conducts an empirical analysis of the basic situations,main types,compensation scope,and liability proportion of the tort liability borne by educational institutions based on 110 judgment documents,starting from student injury accidents that occur in ordinary public primary and secondary schools and public kindergartens in Heilongjiang Province,emphasizing the compensation and prevention functions of tort liability,in order to promote educational institutions to raise risk prevention aware-ness,strengthen safety management,reduce the occurrence of student injury accidents,improve the ability of managing schools ac-cording to law continuously,and effectively protect the legitimate rights and interests of students and schools.
