The Challenge of the Times and Rule of Law Response of the Maritime Litigation System in the Context of Chinese Modernization
As an important part of the modernization of the rule of law of the sea,the Chinese modernized maritime litigation system should be combined with China's specific realities,rather than simply copying the maritime litigation model of western modernized countries.While adapting to Chinese characteristics,the Chinese modernized maritime litigation system is also facing the challenges of the times in terms of limited maritime judicial resources,conflicting maritime jurisdictions,weak maritime criminal procedure system,barriers to the protection of the marine environment and ecology,and shortcomings of the rule of law in maritime litigation involving foreign countries.In order to promote a Chinese modernized maritime litigation system,it is necessary to be based on China's actual situation,respond to China's problems,and focus on optimizing the allocation of maritime judicial resources,perfecting the jurisdiction system for maritime litigation,strengthening the maritime criminal justice system,perfecting the mechanism for the protection of the marine environment and strengthening the rule of law among other areas relating to foreign affairs in maritime litigation.
