Legal Regulation on the Application of Face Recognition Technology under the New Security Landscape
Under the new security landscape,the rapid development and wide application of face recognition technology not only promotes scientific and technological innovation and social governance,but also causes algorithm security risks and facial information risks,which brings challenges to the governance of face recognition technology in China,including the realistic dilemma of scene regulation,legal remedy and decentralized supervision.In this regard,based on algorithmic security theory and digital human rights theory to respond to governance needs,this paper compares and examines the characteristics of legal regulation in the EU,the United States and other places from three dimensions of legislative system,judicial relief and regulatory mechanism,and combines advanced legislative experience outside the region to put forward the path improvement suggestions,including constructing the scenario-based legislative regulation model,facilitating the judicial relief system,and improving the coordinated supervision and management mechanism.
